Welcome to the Future of Product Testing

These Terms of Service ("Terms") govern your use of the chebeMCHN website and product testing services (collectively, the "Services") operated by Beautiful Exquisite American Magic, LLC ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services.

1. The Vending Revolution Agreement

chebeMCHN is revolutionizing how Consumer Packaged Goods (CPG) makers test and launch their products. Our smart vending machines provide a platform for real-world product testing and consumer feedback. By using our Services, you're joining our mission to transform product testing through innovation.

2. Product Submission Guidelines

When submitting products for testing through our Services, you agree to:

  • Provide accurate and complete information about your product
  • Ensure your product complies with all applicable laws and regulations
  • Deliver products that are safe for consumer use and consumption
  • Provide products that are properly packaged and shelf-stable
  • Maintain appropriate insurance coverage for your products
  • Accept responsibility for the quality and safety of your products

3. The Texas Two-Step Testing Process

Our testing process, affectionately known as the "Texas Two-Step," involves:

  1. Step One: Consultation and Planning - We'll work with you to understand your goals and create a custom testing plan.
  2. Step Two: Deployment and Feedback - Your products will be placed in our strategically located machines, and we'll collect valuable consumer data and feedback.

We reserve the right to refuse any product that doesn't meet our standards or that we believe may pose a risk to consumers.

4. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Beautiful Exquisite American Magic, LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Beautiful Exquisite American Magic, LLC.

By submitting your product for testing, you grant us a non-exclusive, royalty-free license to use, display, and distribute images and information about your product for the purpose of providing our Services.

5. The Lone Star State Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

6. Limitation of Liability

In no event shall chebeMCHN, Beautiful Exquisite American Magic, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use or alteration of your transmissions or content.

7. Indemnification

You agree to defend, indemnify, and hold harmless chebeMCHN, Beautiful Exquisite American Magic, LLC, and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or your violation of these Terms.

8. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
